POLICY ON PRIVACY, DATA, COOKIES AND MARKETING COMMUNICATIONS (“POLICY”)

This Policy sets out how Funbakers Limited ("we") may obtain and use certain personal and non-personal information, which we may acquire when you download and interact with the "Silent Streets" App (the "App"). You should carefully review this policy prior to downloading and using the App.

1. About us

1.1 Funbakers Limited, registration number 587828, tax reference number 3451944HH, is a private company limited by shares, registered in Ireland, with our registered office address at 66 Silken Vale, Maynooth, Co. Kildare, Ireland W23 V3P2. For the purposes of the Data Protection Act 1998, we are the data controller in respect of any personal data, which you may submit to us.

2. Data

2.1    We may ask you to submit, and / or you may submit, certain personal and non-personal information and / or data to the App (such as your name, email address, Apple Game Center ID / Google Play Games ID and other registration information), transaction-related information (such as when you make purchases or respond to any offers), information concerning your use of the App or any of its related services, and information you provide us when you contact us for customer support.

2.2    In addition, the App may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, GPS coordinates, motion tracking information, information from your device’s camera, information about which parts of the App and its related features and services you are interested in and your usage patterns, game play logs (distance traveled, time, date etc).

2.3    This information will be kept secure by us in accordance with the Data Protection Act 1998 and may be used to:

2.3.1    process and make available the App;

2.3.2    enable your use of the App and associated services;

2.3.3    open and run your user account and provide you with an up to date, efficient and reliable service;

2.3.4    monitor the use of the App;

2.3.5    monitor your contributions (if any);

2.3.6    keep you updated on the App news and developments and related services;

2.3.7    to generate anonymous and aggregate data reports to highlight the use of the App; and

2.3.8    to comply with any Apple or Google policy or law enforcement request.

2.4    WE WILL ONLY USE INFORMATION COLLECTED ABOUT YOU IN ACCORDANCE WITH THE DATA PROTECTION ACT 1998.

2.5    We will never collect sensitive information about you without your explicit consent.

2.6    If you believe we have information about you that you do not want us to have or that is incorrect please contact us as described below and we shall correct or remove the data as you request as soon as is reasonably practicable and/or provide details to you of how you can update the data.

2.7    When you use your Apple Game Center ID or Google Play Games ID to connect your Apple Game Center or Google Play Games account to the App, please note that you will be sharing additional information with us from your Apple Game Center or Google Play Games profile. Such personal data shall be used in accordance with the Apple and Google policies and this Policy.

2.8    We may use servers outside the EEA to store any data which we acquire from your use of the App, and where we do so, we shall ensure that our data processors agree to handle the data in accordance with the Data Protection Act 1998.

2.9    We will use reasonable and industry standard measures to safeguard the personal data we hold. However no system can be 100% secure, and therefore despite our best efforts, there could be unauthorised access to this data and therefore by using the App you accept this risk.

2.10    In the event that Funbakers Limited is subject to a purchase or all or some of its assets by a third party, then the personal data shall be deemed an asset which may be transferred to the third party.

2.11    Please note that if you are below the age of 16 you should not provide any personal data to us. If you are older than 16 years of age, but below 18 years of age you should obtain the consent of your parent or guardian before you submit personal data to us.

2.12    You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

3. Profiles

3.1    As part of the App, you may create your own profile showing your progress through the game, which may include personal data that you have submitted to us. The default setting of the App will not share this information with other users of the App or the general public, but you may opt to share this information with your friends and the general public.

3.2    You may also opt to share your information and use of the App on social networks such as Facebook and Twitter. You should check your privacy settings of those networks to ensure you are happy with the way your information is shared.

4. Location Data

4.1    By using the App, you will share with us your actual physical location. We use this information to measure your speed and distances traveled in order to adapt the game challenges presented to you by the App, however this information will remain accessible only to us unless you decide to share the data publically via the App.

5. Access by third parties to information obtained by the App

5.1    We will share information, submitted by you or automatically collected by the App, with third parties only in the ways that are described in this privacy statement. We may disclose user submitted and automatically collected information:

5.1.1    as required by law, such as to comply with a subpoena or similar legal process;

5.1.2    when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

5.1.3    with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement

6. Marketing Communications

6.1    We will not pass, sell or trade your information on to third parties unless you give your consent or you have given it already.

6.2    We may use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

7. In App Adverts

7.1    Our App may have advertising displayed within it, as part of an advertising networks or our own advertising. Where advertising is delivered via third party networks, we are not responsible for the selection and serving of adverts.

7.2    The advertisers and Apple or Google may serve cookies and web beacons (and other similar tools) to personalise adverts to you. Please review the relevant privacy policies of Apple or Google, depending on your device’s operation system, for further information.

7.3    We may use GPS technology (or other similar technology) to determine your current location in order to personalise the advertisement. If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

8. Consent

8.1     By using the App, you are consenting to our processing of your information as set forth in this Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.

9. Changes

9.1    This Policy may be updated from time to time for any reason. We will post the new Policy on the App website, www.silent-streets.com, and notify you of any changes to our Policy in the App’s update notifications. You are advised to consult this Policy regularly for any changes, as continued use is deemed approval of all changes.
